PCBU (Person Conducting a Business or Undertaking) has a duty to consult with those who are, or are likely to be affected by matters relating to WHS.
Failure to consult:
Max. Penalty – Individual $20,000 – Body Corporate $100,000
When is Consultation Required?
• Identifying hazards and assessing risks.• Making decisions about eliminating or minimising risks.• Decisions on adequacy of facilities for the welfare of workers. (e.g., First aid, dining, washrooms)• Making decisions about procedures for: Consulting with workers Resolving WHS issues Monitoring health of workers (e.g., hearing tests) Monitoring conditions at any workplace (heat, cold, odours, etc.) Providing information and/or training
• Carrying out any other activity prescribed by Regulations.
Your Options for Consultation:
There are three options available to workers. They have the choice of selecting the type of consultation best suiting their needs and the PCBU must adhere to their selection.
An Elected WHS Committee
1. If there are five or more workers in the business and they select the option, or an HSR decides that is the best course of action, a WHS Committee must be formed. (usually, one per work group, i.e., one from the office, one from sales, one from forklift operators, one from drivers, and one from warehouse, based on a company employing approx. 20 staff.
Approved Work, Health and Safety Training help HSR's to understand and fulfill their roles and responsibilities. It gives you the skills, knowledge and confidence to represent your workmates and to help make your workplace a safer environment.
• SafeWork approved WHS 5-day Training Course. • Following the WHS 5 Day Training Course, a 1-day refresher course every year.
• WorkSafe approved OHS 5-day Training Course for VIC.

2. If workers request it, HSR's (Health and Safety Representatives must be elected) usually one per work group, as above.
• If 1 or 2 are selected, the elected staff must undertake a 5 Day WHS Training Course. • If you have existing committees or HSR’s, they must undertake a refresher 1 day course.
